Terms and Conditions
Important – please read this section before making a booking.
Note – these terms and conditions are listed here for reference purposes only. Please refer to the actual terms and conditions document you will sign when the inflatable you have booked has been delivered.
Safety Instructions
In the interest of safety we advise that the following safety instructions are stricly adhered to:
- Adult supervision is essential while the equipment is in use.
- Ensure that no persons are on the inflatable while inflating or deflating.
- Under no circumstances must the equipment be interfered with, or moved. In the event of malfunction, contact us immediately.
- The power point must be kept dry at all times. The plastic cover is supplied upon delivery and must not be removed.
- Persons using the inflatable must not use hard footwear. Also, toys, sharp objects, and food and drinks, should not be brought onto the castle.
- At no time should anyone climb onto the back walls or side walls of the inflatable.
- At no time should there be overcrowding on the inflatable. It is recommended that children of the same age group use the inflatable at the same time.
- Persons under the use of alcohol or any intoxicant should not use the inflatable.
- In the event of high winds or inclement weather, it is important to deflate the inflatable immediately until such a time as the winds or rain have subsided.
- All persons supervising must be aware of the above safety points.
- No persons under 5 years are to be allowed on the inflatable slides.
General
Definition and law
This contract is an agreement for the hire of inflatables and accessories (the “Equipment”) detailed overleaf and will be governed by Irish law. The parties to the contract are:
The hirer (the “Hirer”)
Gort Bouncing Castles (the “Supplier”)
Where the hirer is not an individual acting in person, the person whose signature appears on the contract is the Hirer.
No variation or addition to this contract shall be effective. If any condition is held to be invalid the others will not be affected. A decision not to enforce any condition will not constitute a waiver of the Supplier’s rights.
Extent of Contract and non assignability
The contract will be effective when the Hirer places a detailed order and the Supplier has accepted it. The Contract is not assignable.
Maximum Period Of Hire
If the Hirer is an individual, partnership por an unincorporated body the Contract will at latest terminate upon the expiry of one month from the date of commencement.
Termination of the Contract
If the hirer is in breach of contract or is involved in insolvency or liquidation proceedings, the supplier may terminate the contract and repossess the Equipment without affecting any rights to recover monies due, including damages for breach of the Contract, or any other remedies.
Ownership of Equipment and Goods
Equipment remains at all times the property of the Supplier.
HIRE CHARGES
Basis of Charging
Charges and commencement dates are as stated and charges include Saturdays, Sundays and Public Holidays, until the Equipment is returned.
Transport
Delivery or collection (including attempted calls) will be charged at the Supplier’s current rates. Quoted charges include 15 minutes attendance at the specified address. Extended waiting times may be charged for.
Time for Payment and VAT
The Hirer will pay all monies due, including VAT and on demand interest on amounts overdue are at Bank Of Ireland Overdraft Rate plus 4%. The Hirer will be liable for any reasonable legal charges incurred by the Supplierin the recovery of the amountdue and/or equipment.
Cancellation Charge
20% of the hire charges for the unconsumed hire period will be due in the event of early cancellation.
Failure to allow inspection of Equipment
If after reasonable notice the Hirer fails to make the Equipment available for inspection the Supplier may treat it as having been lost and levy a penalty charge against the Hirer to the full replacement cost.
HIRER’S RESPONSIBILITIES
Damage or loss costs
The Hirer will pay for rectification, cleaning, or Equipment loss. The cost of damage repair will also be payable by the Hirer. Severe damage or Equipment loss will result in charging full replacement cost. Hire charges will accrue until settlement is made.
Deliver inspection and receipt of Equipment
The Hirer/Signatory will examine the Equipment at physical handover to ensure satisfaction and sign in confirmation. For delivered items, any shotage or damage must be noted on the delivery note.
Return of Equipment
Equipment may be returned during normal business hours or arrangements made for collection. The Supplier will issue a return note for any Equipment returned without which the Hirer will remian liable for on-going hire charges.
Security of Equipment
The Hirer assumes responsibility for the Equipment and undertakes not to sell, re-hire or part with possession, alter, repair or modify it in any way. The Hirer is responsible for the loading/unloading of Equipment and Goods and assistance given by the Supplier is at the Hirer’s risk.
Lost or stolen Equipment
The Hirer agrees to insure the Equipment against all risks on a ‘new for old’ basis with any claim settlement receipts from an insurance company or other source being held in trust for payment on demand. This liability is without prejudice to any Supplier rights under the Contract. Equipment purchased to replace lost or stolen items is the property of the Suuplier.
Maintenance of Equipment and breakdown procedures
The Hirier is responsible for the safety, safe use, serviceability and cleanliness of the Equipment throughout the hire period and must immediately notify any breakdown or shortcoming to the Supplier without attemping a repair.
Signatory’s Warranty
The Signatory warrants that he is authorised by the Hirer to enter into the Contract and indemnifies the Supplier against all losses and costs incurred if such authority s misrepresented.
SAFETY PROCEDURES AND INDEMNITY BY HIRER
Acknowledgement of safety instructions and safe use
The Hirer/Signatory acknowledges receipt of appropriate instruction in the safe and proper operation of the Equipment and confirms and certifies that the Supplier has read the instructions to me and I understand same. I undertake that it will only be used in accordance with those instructions. The Hirer hereby indemnifies the Supplier against any expense, liability, loss, claim or proceedings for any personal injury or damage to or loss of any property arising from, or in connection with, the Contract or by way of performance of any of the conditions contained herein.
SUPPLIERS RESPONSIBILITY
Supply of Equipment and limitation of Liability
Liability for claims made by the Hirer will not expose the period hire charges or the price of Equipment whichever is less and does not extend to any consequential of financial loss liability caused by late or non-delivery of Equipment, its unsuitability, breakdown, stopage or lawful repossession. The Supplier may substitute items of similar quality or performance when necessary.
Delivery and collection
The supplier will endeavour to deliver or collect during the business day following that on whih chthe request is received and the Hirer or his representative must be present when dlivery or collection occurs.
